Keith Faber better rethink running for Attorney General

David Esrati |

October 08, 2025, 03:13 PM |

The current Auditor of the State of Ohio is Keith Faber, and he’s term-limited. His next stepping stone (or so he thinks) is to run for Attorney General. He’s also the guy in charge of prosecuting Montgomery County Clerk of Courts Mike Foley, or more accurately, mis-prosecuting him so far.

First, Faber’s office charged Foley with 12 counts. Then they agreed to toss 10 of the counts and let Foley plead no contest to two. One was a felony, which should have triggered immediate removal from office.

But no.
Faber’s “crack legal team” didn’t think they had any right to remove Foley from office and stood by while Foley’s plea was withdrawn after I had already filed a Quo Warranto action to remove him.

A hearing was set for December on all 12 original charges. Then, late Monday, Faber’s office quietly filed a “Notice of Nolle Prosequi” which is legalese for “we’re dropping charges.”

The Seven That Disappeared

Out of the twelve counts, the first seven were dismissed by Special Prosecutor Thomas Anger from Faber’s office. Those were the charges most closely tied to former Judge James Piergies, who had already resigned his seat after his own plea deal.
Piergies stepped down. Foley? Still collecting a paycheck, still in office, and still laughing all the way to the bank.

That leaves just five counts limping forward. Two of those are the same ones Foley already pled to, and then magically got to un-plead when Judge Jonathan Hein decided it would be a “manifest injustice” to actually enforce the law.

The Fix Is In

When a regular citizen faces a 12-count felony indictment, they don’t get to cherry-pick which charges go away. But when you’re an insider in Montgomery County’s “Culture of Corruption,” apparently, the State Auditor’s office becomes your cleanup crew.

Let’s be honest.
Keith Faber’s office has botched this case from day one. Either his prosecutors don’t understand how felony disqualification works under Ohio law, or they’re protecting one of their own. In either case, it’s not justice, it’s collusion.

This isn’t about paperwork mistakes or “technicalities.”
This is about the Auditor of the State of Ohio deciding that seven public corruption charges — tied to contracts, conflicts, and abuse of office — aren’t worth pursuing. And let’s be clear, Piergies idiot son wasn’t qualified for the job Foley gave him in exchange for money from Piergies court budget to employ him. The taxpayers got screwed employing a moron, and Piergies and Foley got away with it.
Meanwhile, the one guy who blew the whistle, filed the case the State wouldn’t, and dragged this mess into public view, me, is being told I might not have standing.

The Pattern Is the Problem

In Montgomery County, justice has become a punchline. We’ve seen it all before:

  • Prosecutors who protect their friends.
  • Judges who retire before the hammer falls.
  • Plea deals that evaporate when sunlight hits them.

Now we can add Keith Faber to the list, the man who wants to be Ohio’s next top cop, but can’t even manage to finish the job he’s already botching.

Faber’s team has turned the Foley case into a masterclass in how to make corruption disappear. They had 12 shots at accountability and decided to throw away more than half of them.
And they’re doing it on your dime.

The Bottom Line

The law says convicted felons can’t hold office. That’s black and white.
But in Faber’s Ohio, it’s all gray, because when insiders break the rules, the enforcers hand out rainbows and lollipops.

If Keith Faber thinks this kind of “justice” qualifies him to be Attorney General, he’d better think again.
Ohio doesn’t need another politician who prosecutes the weak and protects the powerful. We’ve already got too many of those.

What’s Next?

I’ve filed my motion on standing in the Court of Appeals and Foley’s lawyer has until the 15th to respond. Then, the court of appeals will probably delay some more. Foley’s criminal case is due in December, but with Judge Hein, who knows what could happen next.

Just fed up with all the BS that goes on in this area, this state. Faber needs to retire and not be Attorney General. He doesn’t have my vote. Mathias Heck Jr needs to retire because he’s corrupt. I’m glad that miserable Magistrate Durden retired.

Ray Johnson

I have a personal reason why I say good riddance to Magistrate Durden. Juvenile Court is screwed as well!

Melissa

This is what happens when voters elect indicted / convicted felons up & down the ballot.

Convicted felons can and do hold public office. Republican Donald Trump is the highest example of a convicted felon who was elected to the highest office in America. What a corrupt circus his administration is – as we knew it would be. Enjoy habeas corpus, free speech, religious freedom, healthcare, and a job while you have it.

Current Trump loving Republican Ohio Auditor Keith Faber contributed money to former MAGA Ohio House Speaker Larry Householder, who currently sits in prison on a 20 year sentence for various House Bill 6 crimes. He probably prays daily to his porcelain god (stainless steel) for a Trump pardon. Householder’s crooked sidekick, former Ohio Republican Party Chair Matt Borges, just got sprung early from prison (TODAY!) for his part in the HB6 corruption.
https://www.cleveland.com/news/2025/10/ex-ohio-gop-chair-matt-borges-convicted-of-role-in-hb6-scandal-leaves-prison-early.html

Republican Clerk of Court Mike Foley has been shady for a long time, yet was elected while indicted. Fellow Republican Auditor Keith Faber was premature out of the starting gate on the Mike Foley conviction with his press release. Foley will have his criminal trial in two months. Once he is convicted for good, he will be removed per Ohio statute.
https://ohioauditor.gov/news/pressreleases/Details/7625

And now, we have a local Republican former AMVETS commander who just pled guilty to one count of wire fraud and was indicted for stealing more than $600,000 for personal use at “gentleman’s clubs”, hotels, gambling.
https://www.daytondailynews.com/local/former-dayton-amvets-commander-accused-of-stealing-more-than-600000-pleads-guilty/4HYQKTNXIVBIXD4KJ3JAW3FHCU/

The Republican Party is full of thieves who steal from citizens. It hurts all of us and voters should really make an effort to kick all of these crooks out of office, stop putting them in office – no matter the political party really – and get back to the business of good, honest, hard-working governance we can be proud of. Early voting is going on now. Election day is Tuesday, November 4th. Let’s do our part to have a good life, shall we?

Tim Hart

When will Melissa figure out that Trump is actually good. LMFAO !

TDS is Real !

Melissa

Yeah, Tim, Republican Donald Trump’s derangement is real, alright. I hear he’s at Walter Reid getting some medical attention today. Even your good buddies, Qanon Queens Laura Loomer and US House Rep MTGreene, think Donald Trump’s lost his marbles.

I wonder what the military brass at WPAFB and Mike Turner’s wealthy military contractor donor friends think about the announcement today from former Fox talking head, drunk, and Trump’s current Republican SecDef, Pete Kegsbreath, allowing Qatar to build a military base on American soil in Idaho?

Trump got that free jet from Qatar and the Trump Crime Family gets to build a $5.5 Billion golf course in Qatar, so it looks like a quid pro quo going on, but I could be wrong. We should ask Congress – oh wait, can we?

https://bsky.app/profile/trending.bsky.app/feed/444955505

The stock market is down today. Trump won’t meet with Xi now. Farmers are getting screwed and it’s harvest season. Noem and Miller are gleefully plucking kids & adults off the streets of American cities and disappearing them. Healthcare and food prices skyrocketing. Jobs vaporized.

Yeah, Tim, so much winning under the Republican Party and Trump regime…

The Old Bandito

…your diagnosis is correct Tim Hart. A clinician would probably affix a “stage four” designation to this particular case of TDS.
Take this post for example. A commentary on the state auditor and Montgomery County where the President lacks jurisdiction and whose named is not mentioned.
Leave it to your favorite to dump on Trump, as if he were responsible for David’s case getting tossed. I suspect if David posted a critique of Sherbrooke hockey sticks or listed a recipe for apple pan dowdie, your gal would find it essential to rag on Trump in her response. I suggest immediate clinical evaluation and intervention…

Corruption by the democrats or left leaners is big at the federal level.. Comey charged for making false statements and Obstruction of Justice. Comey cannot just make the case for malicious prosecution. I have a case against the Ohio Democrats for malicious prosecution. My case was dismissed and sealed and I pleaded not guilty. Letitia James indicted by a grand jury. Trump didn’t go after James, evidence was presented to a grand jury. The evidence is great for mortgage fraud. The democrats that went after Trump are guilty of crimes themselves! While Republicans at the state/local level in Ohio have corruption tendencies, I’m more interested in seeing Letitia James squirm in a court room. Those who go after Trump will get the same Justice. I remember when James said “ No one is above the law”. Let’s see if that’s true. Adam Schiff is next.. For these federal cases, all are presumed innocent until proven guilty. Why do I say that? The Judges in these cases may be Democrats..

Melissa

Thanks Dr Ice Bandit (Old Bandito) for your 2nd opinion. I’ll take it under advisement.

Speaking of the Liar In Chief, did you see Trump got his Covid shot Friday at Walter Reed despite the admonishments of Dr Brain Worm (Robert F Kennedy, Jr)? I guess Trump is inoculated for his cankle troubles, too. If you need some RX relief America, Trump has prescribed this for you and LQQK it’s already branded for the Trump grift.

Mr Big Balls (Edward Coristine) and Mr. Airbnb (Joe Gebbia) are still on the DOGE design team. Who knew they were so talented at designing all of the dot gov sites like this one at ndstudio dot gov? Trump’s hawking his gold card to uber rich foreigners…how come?
https://x.com/ndstudio

Take heart, gents! At least we can watch this to take our minds off our healthcare troubles as the USA goes straight to H E double hockey sticks. David can probably do some of these snazzy moves now with his new hip and skates so that’s COOL!

Melissa

Democrat David Esrati is trying to hold government to account with his blog and I support his efforts. I don’t need to explain myself to his Republican blog commenters. Fall back on your MAGA talking points. My words speak for themselves – read them or not. Republican Mike Foley was indicted by a grand jury. He was elected while under indictment. We’ll see what a jury of his peers finds in his upcoming criminal trial in December 2025. I look forward to seeing the evidence. Mike Foley has always been a crime adjacent person. Look back and see where he has been and how he has conducted himself. Go have a chat with his first wife, his tax business history, Fesum Ogbazion trial witnesses, and former chum Tyler Starline, who can speak to the title agency activities they shared. Foley is a bit like Trump in that they both leave a lot of churn in their wake. Republican Keith Faber is making criminal prosecution choices in the Mike Foley criminal case. Yet Faber supported Republicans Larry Householder, Matt Borges, Mike DeWine, Jon Husted, and the Republican Ohio House Bill 6 criminals. Faber apparently condones crime with his support/actions as Ohio Auditor and is unfit for Ohio Attorney General, a position he seeks. Republican James David Vance is an embarrassment to Ohio. He is inexperienced for government service and exercise of fiduciary duties for the country, apparently cannot tell the truth, and is untried on the world stage. His rich foreign donors put him right where they want him. It is obvious he is unfit for office. Republican Donald Trump was indicted by a grand jury and convicted of 34 counts by a jury of his peers. He was elected while a convicted felon and he remains a convicted felon. He lies and commits crimes and ethical breaches daily. We’ll see how many more times he is impeached before he is finally removed from office for his blatant corruption. He is bought and paid for by foreigners. Trump is unfit for office and always has been. Either the American people reject… Read more »

Melissa,
Felon or not. Trump accomplished something today which democrats like David and you dismiss. Trump worked with several Arab states and Hamas and Israel and a few European states to end the war in Gaza. A dictator would have done it himself. Biden would have never accomplished this, Blinken coined the phrase “ I don’t think you have credit for that”. In response to Israel’s war in Gaza. Meaning Israel should have stopped the war soon after it started in 2023. This is part of the reason I switched parties. David and Melissa, do you support Trump’s effort to bring the war to a close? Don’t hear too much from democrats today except for the Clintons. Where is the ceasefire now crowd? Trump outlined a 20 point plan to end the war in Gaza and bring home the hostages. Obama and Biden are anti Israel, so is Harris, even with a Jewish husband. As Netanyahu said, Trump is the best friend to Israel they have ever had. This is why Trump won the election. About a million Jews switched their vote from Biden/ Harris to Trump in 2024. Israel asked Trump to speak at the Knesset, a great honor. You can call him a felon, a felon 77 million people voted for. Trump has accomplished more in 9 months than Biden accomplished in 4 years. I’m proud to have voted for Trump because of moments like these. Can you give Trump credit for this great accomplishment? If you can’t you have TDS.

Melissa

Herb, it appears we may agree on some things:

1) Preventing/stopping war is always good and people should champion that.
2) Trump is a felon & helped clinch a ceasefire/hostage swap in the Middle East.

We could agree on this truth, but I guess you want to chime in with your GOP mates:

3) You are another fake doctor on this blog to diagnose me with TDS, a fake malady.

Here are some historical events that recently happened:

4) President Joe Biden brokered a ceasefire/hostage swap before he left office (this is still on the current White House website, something Trump and DOGE didn’t scrub).
https://www.war.gov/News/News-Stories/Article/article/4032622/biden-announces-ceasefire-deal-between-hamas-israel-in-farewell-address/

5) President Donald Trump was bought and paid for by super rich elite Zionists such as Sheldon (deceased) & Miriam Adelson – here’s Trump thanking Miriam in the Knesset.
https://www.youtube.com/shorts/XIyID8hfRM8

6) Trump pardoned America’s Jan6 criminals – here’s Trump telling the Israeli President to pardon internationally-indicted Bibi Netanyahu for his crimes.
https://www.youtube.com/watch?v=Esx7LEXxSLo

Melissa

You may have the impression from all the political posturing and pressure campaigns that Donald Trump has achieved Middle East peace. If so, you are mistaken. He has not.

Within 24 hours, Israel killed 7 in Gaza and held up food aid for starving Palestinians while Hamas executed men in the street and refuse to turn over all hostage bodies.
https://www.youtube.com/watch?v=pPpw3e3SLwM

To be clear, Trump and Netanyahu still want Trump Gaza – the Riviera of the Middle East – but it remains a figment in their vainglorious, criminal minds.
https://www.youtube.com/watch?v=PslOp883rfI

However, Trump’s son-in-law Jared Kushner, and Bezalel Smotrich, Israel’s extremist ultra-nationalist finance minister who opposes the Gaza deal, are both anxious to get their mitts on Palestinian real estate – excited even.
https://www.theguardian.com/us-news/2024/mar/19/jared-kushner-gaza-waterfront-property-israel-negev

In the coming days, I will be interested to learn the backstory involving Qatar, their lobbyists (Pam Bondi, Susie Wiles), the Kushner/Trump crime families, and the money trail. Jared Kushner doesn’t have a security clearance and isn’t on the government payroll. Or, is he?

Herbert Morris

Melissa,
I never said you had TDS, but you didn’t really give Trump credit for this accomplishment in your response.i agree this is only an end to the war and not peace, but Trump has an outline for peace, Hamas has to disarm, Gaza rebuilt and a peacekeeping force deployed as Israel withdraws from Gaza completely. Part of the reason I support Trump now is Biden and the democrats were anti Israel/ pro Hamas. They threatened Israel with no arms shipments and no military aid. I’ve got screenshots that I use on Twitter/ X regarding this. Trump has let Israel get a lot closer to bringing Hamas to its knees. “ All hell will break loose” is Trumps quote. Also please google why Netanyahu is in trouble in Israel. It’s not the ICC, which is bogus as Israel and America don’t fall on the court’s jurisdiction. It’s because of a corruption scandal in Israel, it’s an internal Israel issue. I don’t know the facts. Trump asked Israel’s President, not the ICC for a pardon.

Melissa

Herb, I stand corrected on your TDS allegations then. I agree Trump brokered a ceasefire and hostage swap with other governments like many other leaders have done in the past. Biden did the same before he left office. So many American presidents and world leaders have also tried.

Let’s agree to sit tight and see what happens over the next few days. Pray there is no more killing, the Gaza people can eat, drink, rest, work, be sheltered, and live like normal people. Let’s also pray Hamas and the Zionists get a grip because this path is not working.

I don’t think that was so hard to agree on a few things, do you?

Tim Hart

Here’s the reality of the situation.

Trump is not part of the establishment. This is why they have been trying to stop him 24/7/365, ever since he came down the escalator.

Trump is actually a good President who is truly trying to save the world.

Everything else is a lie.

Melissa

Herb,
“On 21 November 2024, following an investigation of war crimes and crimes against humanity, the International Criminal Court (ICC) issued arrest warrants for two senior Israeli officials, Benjamin Netanyahu, the prime minister of Israel, and Yoay Gallant, the former Minister of Defense of Israel, alleging responsibility for the war crime of starvation as a method of warfare and the crimes against humanity of murder, persecution, and other inhumane acts during the Gaza War. The warrant against Netanyahu is the first against the leader of a Western-backed democratic country for war crimes.
.
All 125 ICC member states, including France and the United Kingdom, are required to arrest Netanyahu and Gallant if they enter the state’s territory. The ICC also issued an arrest warrant for Hamas military commander Mohammed Deif, who was killed in an Israeli airstrike on 13 July 2024 but whose death remained unconfirmed at the time. By January 2025 Hamas confirmed Deif’s death, and a few weeks later the ICC cancelled the arrest warrant against him.
.
Warrants may still be issued against additional Israeli senior IDF [Israeli Defense Force] officers involved in the Gaza War – an action recommended by a United Nations Commission of Inquiry, which also called for genocide charges to be added to the warrant after finding the Israeli government guilty of multiple violations of the 1948 Genocide Convention…”
https://en.wikipedia.org/wiki/International_Criminal_Court_arrest_warrants_for_Israeli_leaders

Melissa

Tim, that might be your reality, but it’s not reality for most of America and the world.

Veep JD Vance is working on Charlie Kirk’s podcast defending adult Hitler and KKK types in Young Republicans groups as “kids”. It looks like Ohio is growing its own fascists.
https://bsky.app/profile/stefsull.bsky.social/post/3m3axsg7ruk2f
https://www.politico.com/news/2025/10/14/private-chat-among-young-gop-club-members-00592146?utm_source=firefox-newtab-en-us

Hamas led terrorist attacks on Israel killed 1,200 people and kidnapped around 250. Israel killed more than 67,000 people in Gaza, with more than half of them being women and children. Rebuilding costs will be ghastly. With Trump’s ceasefire/hostage release in place, SecWar Hegseth preps US troops to deploy to Israel.

Meanwhile, Trump openly orders extrajudicial killings (5 human filled boats now?) and sanctions CIA actions in Venezuela. He refused to answer when media asked if he planned to have the CIA “take out” President Maduro of Venezuela. Shades of Noriega?
https://www.nbcnews.com/politics/donald-trump/trump-confirms-authorized-cia-action-venezuela-rcna237880

I’ll reserve judgment on your definition of Trump being a “good person” when I see evidence of it.

Herbert Morris

Melissa,
Google prosecutor Khan, ICC and corruption and you’ll read that not only does America and Israel not fall under the court’s jurisdiction, this prosecutor Khan has been accused of corruption related crimes. If you believe that Netanyahu committed war crimes, as most democrats do, not sure where David stands on this issue, it’s the reason a lot of Jews switched their votes to Trump from Biden/Harris in 2024. Anti semitism in America and around the world is rampant. Did you know that the United Kingdom banned Israel soccer fans from a match there and several nations want Israel out of Eurovision. The IDF is the only army that warns of impending attacks, does roof knocks, calls, texts Gazans, has relocation zones. Google that too. No nation at war should have to warn of a bomb, but Israel does. Does America warn its enemies that danger is coming, mostly no.

jonathan b

Sure looks like genocide to me, as it does most of the world.

Melissa

Yes, it does, Jonathan. I couldn’t agree with you more.

I don’t know what to tell you, Herb. I have tried to understand what Israel has been doing over the years, but Zionist settlers, radicals, and extremists in Israel have caused much difficulty in the region. They’ve killed their own leaders and other leaders over the years. It’s quite clear Israel wants more land and the settlers have been taking it for decades. I’m truly not trying to be disrespectful in expressing myself here, but something has got to give in the region. Yes, Israel has a right to defend itself and survive as a people. So do the Palestinian people and where they currently live. Genocide has been done by one people to another for eons, yet humanity has supposedly evolved to be above base killing in modern times. Or have we?

This is what Trump put on his own social media platform a few days ago about the situation. I also include a meme of a Bluesky commenter. It sums it up pretty well. In my opinion, Trump and Netanyahu are criminals. Others agree. Their own countrymen and women also agree – in America and in Israel.
https://bsky.app/profile/thegoldentoilet.bsky.social/post/3m3dctzh5zk2g

The White House has officially joined Bluesky. Take a look at how President Trump wants his government and policies to be displayed to the world. He doesn’t govern for all of us and is unfit to serve. No Democrat president would have ever done this.
https://apnews.com/article/trump-bluesky-social-media-fa4c32d9150250548a705b490530767c

And that is why we have this today. America and the world want & deserve better. Designed by ourselves for ourselves, we will not be silenced.
