Today, Montgomery County Clerk of Courts Mike Foley dismissed his civil stalking protection order case against me. The case, Foley v. Esrati (2025CV05807), was filed October 21 and voluntarily dismissed on November 12, 2025, according to a notice filed by Foley’s attorney, Dennis Lieberman, under Ohio Civil Rule 41(A)656679659 Notice of Dismissal.
This comes after Foley’s allegations were promoted in a front-page story in the Dayton Daily News and then followed up with a sizeable story on page 2 a week later. There was also a three-and-a-half-minute segment on 22/45 News with Jenilee Borek. Those reports repeated his claims that I had threatened him, even though the court denied his request for an emergency protection order and no such order was ever issued. Then, despite being terrified for his life, he filed a continuance on the hearing.
He had also filed against former employee Tyler Starline and caused him financial damage through attorneys fees- and being sent home from his job at the Board of Elections. I have no information on if Lieberman has also dismissed that case. It’s been dismissed as well. See Press Release below.
(update less than 10 minutes after publication). Press release from Starlines attorney. Terry Posey Sr. You will want to read it.
The filings in the case are hidden from public view, but I can confirm there were multiple procedural filings before Foley abruptly withdrew his petition. The dismissal occurred before any hearing on the merits could take place.
The episode caused reputational harm and unnecessary legal expense. I had to hire an attorney to respond to a case that never should have been filed in the first place.
Separately, I am preparing to appeal the Second District Court of Appeals’ decision in my Quo Warranto case to the Ohio Supreme Court. That case seeks Foley’s removal from office based on his conviction and subsequent withdrawal of his plea in the ongoing criminal matter scheduled for trial in December. It is a question of Ohio’s Constitutional requirements not being fulfilled by the Ohio Revised Code.
Justice takes time. But the truth, and the court record, will stand on their own.

Yet you, David, support someone who pulls the same crap as Foley– filing bogus civil lawsuits and getting questionable criminal charges filed.
What a wild news day today! Foley folds, the House reopens, & the Epstein emails hit.
Congratulations, David! A dismissal with prejudice would have been better, but perhaps Foley’s criminal trial will do the trick once and for all.
“Rober Mugabe” – an interesting name choice, as far as nationalist tyrants go …
@rober- who do I support that does that?
I know one thing to be true: Tyler Starline is a man of faith and character. I first met him during his first year at UD. I was a non-traditional student, and he happened to be in several of my classes. Over time, I came to know him and his family, and I grew to respect his character, his drive, and his intellectual ability. My own experiences working in Columbus and Washington, D.C. in the 1990s convinced me that I did not want to become a lawyer. Many of the negative stereotypes about the profession—moral compromise and ethical shortcuts—were, in my experience, on full display every day. So, about eight years ago, when I needed legal advice and wanted someone I could trust, Tyler was the first person I called. Despite having recently recovered from a serious medical emergency—while supporting his wife and children through that difficult chapter—he still made time to help me. Speaking with him again reminded me that there are good people in the legal profession. Although nearly three decades had passed since we last spoke, he was unmistakably the same person I had known in college, now strengthened by a lifetime of experience, successes, and tragedies. He never minded my swearing, but I cannot recall ever hearing him take the Lord’s name in vain. When I later learned about the situation involving Foley, thanks to reporting from David Esrati, I had no doubt Tyler was being truthful. What was publicly reported aligned with the Tyler I had always known—someone committed to protecting the integrity of his office and the people working in it. In my view, he was punished for doing the job he was hired to do. Now, instead of acknowledging what happened, some have chosen to attack his character. Tyler and I share the belief that no one’s life should be destroyed, and that redemption is possible when people are worthy of it. But the way he was let go—and the timing of it, following his wife’s long illness and passing—felt profoundly wrong to me. What troubles me further is the way Foley’s shifting… Read more »
Caused “reputational harm” to whom, Mr Ratty? To you? Uh…perhaps you are unaware…
@Donald you are a troll, no one likes you, go away.
Good for you, David. You were never intimidated!
Put that to a vote, Mr. Ratty, though I suspect you will rig the outcome (you Metroid Maoist, you). Should your sentiment prevail, I promise to go away. However, you have a poor record in hustings, haven’t you, Mr. Ratty.
I vote to bounce Donald if he won’t add logical, fact-based, or humorous content here. All he ever does is do name calling or say utter nonsense about GL or DE. The comments have no basis in fact and they’re not even funny. Donald, shape up or ship out!
Seeing lying criminal perverts in the Oval today, here’s an Ohio authority on all three:

I’m holding out for the depo transcripts on why he didn’t report the OSU student abuse.
