Do the worst attorney’s work for the State of Ohio?

Kevin Wright’s attorney has been warned that the State’s two genius attorney’s in the evidentiary hearing for his new trial, now plan on appealing Judge Wall’s decision to grant Wright a new trial. This is a day before Wright’s bond hearing to get him out of prison, where he has sat for the last 4 years because of the incompetent defense of his attorney, Jay Lopez.

I sat through that 4 day hearing, where Wright’s attorney Stephen Palmer, absolutely decimated all the evidence presented in court to hang Wright. (Full disclosure, I was paid to film the hearing by Wright’s step-father). I had no dog in this fight going in, but after listening to expert witness after expert witness present their findings of the analysis and evidence used in finding Wright guilty, the only person who should have gone to prison was Lopez, who mounted no defense what so ever, and failed to properly represent his client. After the 4 days of evidentiary hearing, the same could be said of the two attorney’s for the State who were supposed to prove that Wright in fact did have a fair trial. I already told you what I thought of one in my last post- but now the State’s team of Andrea Boyd and Nicole Amrhein think they should appeal Wall’s 44 page, carefully worded and very clear ruling, saying that she is an idiot- the trial was fair.

Frankly, I don’t know why the State even pays these two, their lines of questioning, their defense of the prosecutors work, of the states witnesses was non-existent. Amrhein, was particularly annoying and lost her in lines of cross-examination. The reality is, if you think the evidence was there, or is still there, go ahead and try the case again- which is what Judge Wall ordered. What they are doing with an appeal, is attempting to kick Kevin Wright in the nuts again, after he’s been locked away, in isolation, for 4 years. And to be clear, the whole reason they were in court in the first place, was that the 2nd District remanded the case back to the trial court for this hearing- they already believed there was enough evidence to justify overturning the original verdict.

Here’s what’s supposed to happen tomorrow. Judge Wall is going to set a bond for Kevin Wright, to be released from prison, until the state proves through another trial, that he was in fact guilty. Wright was on bond while his case was in progress when he was first charged, home, with his now x-wife, and his three children (all younger than his step-daughter who was his accuser) for months. Putting him on bond has not been a problem before, and he didn’t even have an ankle monitor the last time.

Instead, Boyd and Amrhein, think he should stay in the Miami County Jail and stew, until the 2nd district rules. Last time he was in the Miami County Jail, a few jailers were disciplined for posting their opinions of Mr. Wright while in their custody- which is a no-no. I have the screen shots of C.O.’s E. K.’s inappropriate posts, but hope that the Sheriff properly dealt with her public editorializing.

What is also coming eventually is a giant lawsuit to pay Kevin for the 4 years of his kids lives he missed due to the failings of the justice system to truly prove beyond a reasonable doubt that he in fact did it. The award will undoubtedly be more than Boyd and Amrhein’s lifetime earnings from the State, which I’m sure, they are willing to put on the line that if they lose, they forfeit their retirement, and are on the hook for at least half of the judgement against the State (which by the way, should include money from Lopez, who was more worried about his wife’s election than his clients defense).

Since they could file right up until 11 am tomorrow, and it’s only a notice, not an actual brief defining their argument against Judge Wall’s decision- which could take weeks, I am choosing to post this to put the State on notice- it’s time to get better attorneys.

Considering I just watched the State post zero resistance to Mike Foley’s withdrawal of his “no-contest” plea last week, and now this, I’m starting to wonder if those who can do law, practice, and those who can’t work for the State of Ohio?

When I first reported on the Judge’s decision to grant Wright a new trial, I questioned if the State would even attempt another trial, since there was no evidence left to substantiate the charges. No deleted porn from the phone, not anything even approaching “a lot of DNA” on the panties, evidence showing Wright was on the phone to his wife when the alleged assault took place, bad investigative techniques and interviews, and they would be facing a competent defense attorney.

If Boyd and Amrhein do file, I hope the 2nd district acts swiftly and with prejudice. Because if you examine the work that we paid for from them- it amounted to a total waste of tax payer dollars. I have the video- all four days- if anyone really needs to see what incompetence in court looks like.

UPDATE

July 10, 15:06- I attended the bond hearing. Mr. Wright was let go on an OR Bond- with electronic GPS monitoring. No unsupervised contact with kids, and limits on travel.

The state, represented by Andrea Boyd, was adamant about no bond, and told us she would appeal- which is laughable, since the court she’s appealing to, sent this case back to Judge Wall for the evidentiary hearing. Boyd is wasting our time and tax dollars. If she really believes the State has a case left, go ahead and bring it to trial. Just realize, this will add more damages the State will have to pay Mr. Wright for this judicial travesty.

And, this time, when nothing big was happening, the Dayton day-old newsless was there “covering it.” Better late than never.

Note to my readers: I published Judge Wall’s decision on July 3rd. The Dayton Daily news had it as a front page story, today. Without the updates you are getting here- like the bond hearing date. CH 7- somehow discovered the story- without giving credit to where they learned of the decision- on July 3rd. Once again, Esrati.com gives you real news, way ahead of the normal news cycle which is all about “if it bleeds, it leads” or if the story was handed to them by PR flacks.
