It’s 6:27 pm and I”m uploading a document that was filed at 3:07PM in the Montgomery County Court of Common Pleas. You can’t go get it online. Someone has to go, ask for a hard copy at the Clerk’s office (which closes at 4:30) and then shuttle it to me- so I can scan it, OCR it and share it with you.
There are 12 counts over 5 pages. There aren’t many new details, but the first count is the doozy: Foley tried “to have Montgomery County Treasurer John McManus move County funds to a private investment firm with which Michael Foley was associated.” McManus, not being a criminal, didn’t do it.
Foley’s Linkedin lists him as “District Manager PFS Investments Jun 2016 – Present · 8 yrs 3 mos” which if proven that this is what he wanted to do is a big no-no.
The charges 2 through 7, all connect Piergies and Foley in transferring Court funds to the Clerks office so Foley can hire and pay Piergies son, Robert, to have a job. This kind of nepotism is rampant in Foley’s office- he also employees former Judge Tony Capizzi’s step-daughter and his attorney, John Paul Rion’s sister- as well as a bunch of political hacks. But, that’s in almost every office in the County Corruption HQ on W. Third Street.
Count 8 and 9 are about Foley using county computers to do campaign work. Count 10 is making an employee work on the campaign on county time, in excess of $7,500 or more.
Count 11 and 12 have Foley soliciting kickbacks from his patronage employees – and anyone else who works for him. Like, “donate to my campaign if you want to keep your nice cushy county job.”
There are no new details, actual work product, proof or anything else in the document. The fact that they aren’t posting this on PRO is criminal and should be investigated. If anyone else gets charged with a crime, it’s there for all to see.

Mike Foley is shady and always has been. He failed to pay his own taxes and had an open Certificate of Judgment on his own Clerk of Court website while previously running as a Republican candidate for Clerk of Court. Taxpayers should take a gander at his public divorce file (download the whole binder, pour yourself a drink, and settle in for an interesting read). See how trashy he ran his life, businesses, and auto title offices.
