Last week Esrati.com scooped all the local media 2x. First with the revelation of which Montgomery County Jail Corrections officers are going to get blamed for the jail’s incompetent leadership and inadequate training – see: Update on Jailers involved in the killing of Christian Black

Then, we broke the story that the taxpayers are going to get a really hefty legal bill which should be paid by Phil Plummer, Jeff Mims and Tom Young and anyone else who voted to single out DPS as being the only school district in the state that can’t buy bus passes for their students. see: Dayton Public Sues the state, and Now we’re Global News laughing stock. Thanks Phil Plummer! That it took DPS and their lackey lawyers at Frost Todd Brown this long to file was embarrassing. The bill will be even bigger. The motion worked, and the district got an injunction granted so they could start handing out bus passes. Ones they’d bought last year.

I set up the registration for the Dayton Bike Gang- an e-bike program for the few, the proud, the brave kids who want to liberate themselves from the stupidity of our elected officials by riding e-bikes to school. The reward? Hit 92% attendance, have a “C” average and graduate- and the bike is yours. So far, about 20 kids have signed up- but I only put the posters up outside the schools last night. An interesting aside, talking to someone high up in the DPS regime, they mentioned a “student union” forming to go bash the hell out of Phil Plummer and his idiot compatriots. If you don’t remember this post from last October, it might be worth a refresher read: The Kids Are All Right [unfortunately, it’s the adults who’ve been acting like children] Of course, this is a work of fiction by the local town fool (me). Do not read it, do not think for yourself, do not pass go, do not collect $200.

The Board of (S)Elections did their thing yesterday in total Oscar awards fashion- no announcement pre-meeting of what they will actually do, and even when they were done, some things are still unresolved.

The Dayton School Board will have 7 candidates for 4 seats. 1 is open- since Karen Wick decided to run with Jeff “screw the kids off the bus” Mims for Dayton City Commission. That leaves us with three incumbents running again: Jocelyn Rhynard, Joe Lacey and Chrisondra Goodwine. The four others who got on the ballot? Chrisondra’s brother, Virgil Goodwine II, former board member Ann Marie “Mario” Gallin who is the best informed candidate ever and most worthy of a return to the board, Jamica Garrison from “Neighborhoods over Politics” and Ken Hayes who has run ineffectively over and over because he doesn’t believe in actual campaigning. But, wait, one of the early favorites didn’t make it on the ballot? D’ajza Demmings who was considered a “sure thing” by the powers that be didn’t make it on the ballot.

Of course there’s more to this story. The board didn’t mention names, but talked about having a 257 hearing either next Wednesday, Thursday or Friday about something. That something was Ms. Demmings.

Slight problem, she turned in petitions claiming she lived on Owens Dr. And doing so, according to the BOLD ALL CAPS text on the petition form- “WHOEVER COMMITS ELECTION FALSIFICATION IS GUILTY OF A FELONY OF THE FIFTH DEGREE” see ORC

No person, either orally or in writing, on oath lawfully administered or in a statement made under penalty of election falsification, shall knowingly state a falsehood as to a material matter relating to an election in a proceeding before a court, tribunal, or election official, or in a matter in relation to which an oath or statement under penalty of election falsification is authorized by law, including a statement required for verifying or filing any declaration of candidacy, declaration of intent to be a write-in candidate, nominating petition, or other petition presented to or filed with the secretary of state, a board of elections, or any other public office for the purpose of becoming a candidate for any elective office, including the office of a political party, for the purpose of submitting a question or issue to the electors at an election, or for the purpose of forming a political party.

Whoever violates this section is guilty of election falsification, a felony of the fifth degree.

Every paper, card, or other document relating to any election matter that calls for a statement to be made under penalty of election falsification shall be accompanied by the following statement in bold face capital letters: “Whoever commits election falsification is guilty of a felony of the fifth degree.”

BOE Executive director called and asked me after I filed the complaint that if Ms. Demmings withdrew her candidacy would it be ok to let this go away? Well, after multiple attempts to stop others from doing this- starting with my first run for Mayor of Dayton way back in 1993 where a guy named “Gary Kidd” filed claiming to live at 205 Bonner St- the next corner over- and was allowed to stay on the ballot- it’s kind of peeved me. Then when I tried to get Dr. Adil Baguirov removed from the Dayton School board because he didn’t live in Dayton, I couldn’t get any help at all. See this infamous video:

This kind of selective enforcement of election law has got to stop. The Greene County BOE had no problem throwing the book at John Stafford for voting at his old address as he was moving- instead of using a provisional ballot. There were also a few others who got slammed for this kind of voter fraud- Larry Ealy and Keith Belluardo were in deep doo-doo a while back, see this DDn article from Feb of 2014: Local governor candidate denies he committed election fraud

Note, Baguirov and his business partner were never investigated for claiming to live on Maryland Avenue.

The BOE did place Bob Matthews on the ballot down in Miami County, despite his delayed legal issues from the state auditors office. These are the same incompetent investigators who couldn’t indict and prosecute Mike Foley in 2 years and then allowed his case to be sealed from the public, illegally. He’s still drawing a paycheck and having fundraisers (to pay for his legal defense probably). The visiting judges from the 12th district that have my quo warranto filing don’t seem to be in any kind of a rush to set a court date.

Once you’re elected, the wheels of justice grind even slower.

In other Miami TWP news, there’s another Barry running for Trustee who isn’t Doug Barry the incumbent- his son, Drew. Considering Matthews is the only opponent, and may be ineligible to serve by November, another monarchy move in the works. But, hey, we’re used to it, isn’t that how Rhine McLin slid into the Statehouse- by royal decree, to finish her daddy’s term.

Unreported by the BOE, because the Dayton City Commission has to act on it tomorrow, the Clergy Coalition managed to get the required new 1250 signatures in record time, and the public hospital exploration tax should be on the November ballot.

I don’t have time to go through and point out how many more races now don’t have choices. It was bad enough when I wrote this: Montgomery County: BOE Report Shows Alarming Number of Unopposed Local Races and it’s even less contested seats now. “If Dayton Public Schools is not able to purchase more Greater Dayton RTA bus passes in September, Dayton Public Schools students can get free bus passes through a community coalition group beginning Saturday, Sept. 23 at 3 p.m. at Mt. Enon Baptist Church, 1501 W. Third St.

Because of that restraining order, DPS is currently able to distribute bus passes that they had left over from last school year. District leadership said the leftover bus passes will last through the end of September.

I have to say the international community seemed to be pretty impressed with Dayton in May:
